Contract for the supply of product

All orders placed with Evolve Innovations are subject to stock being available. If any item is out of stock it will be sent as soon as possible. If there is likely to be a long delay, we will endeavour to contact you to advise of this. If an item becomes unavailable, we will contact you to advise of alternatives and give you the opportunity to cancel the original order. All orders placed with Evolve Innovations can be cancelled provided we have not already shipped the goods to you.

Order Acceptance

The receipt of our email order confirmation does not constitute the acceptance of an order, or confirmation of an offer to sell. Additional verification of information may be required prior to the acceptance of any order. An acknowledgement of your order will be sent to you via email when you place your order, but acceptance of your offer to buy the goods will not take place until after the payment is taken. Evolve Innovations reserves the right to decline the order for any reason.

Payment for the goods and applicable delivery costs can be made by any method shown on the website at the time you place your order. Credit Card or debit payments are taken automatically by Sage Pay or PayPal when the order is successfully placed. Payment is required in complete before the despatching of goods. We will refund the payment if we are unable to supply for any reason.
Prices are subject to change without notice however, when an order has been placed we will always endeavour to honour the price advertised at the point of order. In the rare circumstances where we have to increase the price, we will advise you and offer you the opportunity to cancel the order.
Every effort is made to ensure the prices shown on our website are accurate at the time of order. If an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order.

Goods will be delivered to the delivery/shipping address given when you place your order unless you are contacted by Evolve Innovations. If you fail to take delivery we will try and contact you and re-arrange the delivery, we reserve the right to charge a further delivery charge if required. Every effort will be made to deliver your goods as soon as possible after your order has been accepted, however Evolve Innovations will not be liable for any loss or damage suffered by you through delays in delivery.

We will not accept claims for lost or undelivered packages until 28 business days have passed, from date of dispatch. Of a 7 day week, 5 of those 7 are usually classed as business days (with the exception of UK national holidays and bank holidays). After 28 business days, if the package has still not arrived we will ship a replacement package or offer a full refund, whichever is preferred.
Any claims for damage or incorrectly shipped items must be made within 7 calendar days after delivery of goods.

You have the option to withdraw your order for goods before shipping, and also within 14 calendar days of the goods being delivered. In order to complete withdrawal we require you contact to us either by phone or email [email protected] to arrange this.

The only circumstances in which you cannot withdraw your order within the initial 14 calendar days of delivery, is where you have altered or damaged the goods.

Goods are not supplied on a trial basis.

Returns: All items purchased from Evolve Innovations are guaranteed for 12 months of use. Due to the nature of this equipment no refunds will be given. If you find that there is a problem with any item please return it to us. We will have it carefully examined and will be happy to replace it if it is found to be faulty. Any obvious physical damage or evidence of other misuse found will naturally nullify this guarantee and offer of replacement.

If you need to return any goods due to an issue arising, please contact us either by phone or email to discuss this before sending them back as quite often we can resolve problems over the phone, or email if you are unable to find an answer in our Q & A section.

All returns are subject to an inspection (visual and technical) before any decision is made concerning their resolution.

Distance Marketing

Any non-business customer wishing to cancel an order under the rights provided by the Distance Marketing Regulation Act must do so within 14 days of the point at which the goods were received. The goods must be returned by Signed Delivery(Insured) to: Evolve Innovations Ltd. 201 Longfield, Falmouth, Cornwall. TR11 4SR. Customers are liable to pay the cost of this return postage. As long as the goods have been returned in original unused condition the cost of the goods will be refunded to the customer’s credit/debit card within 14 days of the date of return. Any actual use of a GPS tracker (switching it on and obtaining tracking information) by the customer is a breach of the customers duty to take reasonable care of the product and will negate their right to return under these regulations.

Delivery within the UK

We offer 2 options for customers in the UK:

  1. Royal Mail Tracker 24 This service will take approximately 1 working day.
  2. Royal Mail Tracker 48 This service will take approximately 2 working days.
  3. If you prefer to collect in person, (Local to Falmouth) then this can be arranged. Please contact us to discuss before ordering, but you must book this with us either by email or phone.

Items will be shipped by Royal Mail and are fully insured. Delivery will be as for the services you choose when checking out on the payment page. Delivery times are as above and dependant on selection of service and from the date of dispatch. You will be notified by email when tracker has been dispatched.

Delivery Cost & Times

Orders confirmed before 12 pm will be usually dispatched the same working day. Orders confirmed after 12 pm will usually be dispatched on the next working day.
Occasionally, a particular product is not available for immediate despatch. In the event that we cannot meet our usual delivery times, we will notify you of the expected delivery date by e-mail or telephone, and give you the option to cancel your order or suggest an alternative

Limitation of Liability (General)

Except as specifically stated on this site, neither Evolve Innovations nor any of it’s directors, employees will be liable for damages arising out of or in connection with the use of this website.

This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. Directors and employees of this company may not be held liable for damages relating to either the capital cost of any equipment purchased from Evolve Innovations, or consequential costs associated with fitting and operation of the same when issues arise from the non-availability of GSM and GPRS network coverage.

It is the responsibility of the purchaser to take whatever steps necessary to establish that the necessary and appropriate network coverage is available and that the equipment works efficiently at the location intended for use.
It is recommended that purchasers verify effective operation in countries outside the UK by operating a single tracker unit initially, and prior to purchasing further units. Evolve Innovations will happily provide full technical support for these testing processes. Evolve Innovations does not guarantee that their tracking products will operate successfully in all parts of the world. Variations in GSM and GPRS network make this impossible, and accepts no liability for any loss in connection with failure of tracking service. Every effort will be made to assist in developing the required tracking but it remains the responsibility of the customer to ascertain if network coverage and tracking is possible in any particular global location.

Illegal Acts: It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic ‘fingerprints’ of every order placed on this website to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website. Products purchased from Evolve Innovations may be governed by laws prohibiting their use; it is the sole responsibility of the purchaser/user to comply with these laws and no liability can be implied.

GPS Tracker Installation: For all GPS vehicle trackers that require an installation service with which the customer has agreed and confirmed an installation date with Evolve Innovations and in the event of needing to cancel the appointment, please note that we will require a minimum cancellation time of 24 hours. Any cancellations within 24 hours will incur an £50 cancellation fee.

Website Product Description: Evolve Innovations reserve the right to supply GPS Trackers which may differ in appearance from items shown on the website, but which have the same use, function and facility relating specifically to tracking Notwithstanding any other provision in these Terms:

1.0 Evolve Innovations accepts no liability in connection with any losses incurred by the Customer as a result of the customer failing to follow the user manual (instructions) provided with a GPS tracking device.

2.0 Without prejudice to the other exclusions and limitations in these Terms; Evolve Innovations liability in connection with any order (whether arising in contract, tort (including without limit negligence) or otherwise) shall not in any circumstances exceed the purchase price of the tracker ordered.

3.0 The Customer agrees that it shall not in any circumstances bring proceedings in tort (or otherwise) directly against any employee of Evolve Innovations.

4.0 Evolve Innovations is not liable for any consequential losses (including without limit loss of profits, business or goodwill or loss or damage to property) arising (whether in contract, tort (including negligence) or otherwise) from use of any tracking device, including without limitation in circumstances in which the product fails to function.

5.0 All warranties which would otherwise be implied into these Terms (including without limit as to quality and ‘fit for purpose’ of goods or services) are expressly excluded. The Customer?s sole remedies in connection with such matters in relation to goods supplied shall be in accordance with these Terms.

6.0 Nothing in these Terms excludes or limits Evolve Innovations liability for personal injury or fraud. (6) Whilst every care is taken to ensure that information given on the website, user manual or other documents is accurate, no responsibility is accepted for any errors which may occur therein and such documents do not constitute part of the customer’s contract with Evolve Innovations (save in relation to the technical description, as provided by these Terms). In addition, Evolve Innovations shall not be liable for any losses caused by inaccurate information or recommendations which have been provided to the customer in good faith.

7.0 Without prejudice to the other limitations and exclusions of liability in these Terms, Evolve Innovations accepts no liability (including without limit negligence) or otherwise) in connection with the failure of a device to track if this is caused by lack of credit on a “Pay as you Go” SIM card supplied by the customer or any loss of data due to problems with any part of the telecommunications infrastructure on which the tracker is dependant.

8.0 Evolve Innovation has no liability under these Terms in relation to loss or damage resulting from failure to track occasioned by the failure of any wireless device to perform its function.

9.0 Magnetic trackers are supplied with strong industrial magnets which have been tested to support the tracking device if correctly fitted. The customer is responsible for correct location and how the tracker is fitted. Evolve Innovations is not liable if the tracker is lost or damaged.

10.0 These terms and conditions do not affect (your) consumer statutory rights.
